Moratorium
Moratorium
The option of a moratorium was introduced into the CVA procedures by the Insolvency Act 2000, for the purpose of allowing
creditors and the company during the period the moratorium is in force, the opportunity to consider and vote on CVA
proposals without the company, its business and assets being affected by the commencement or continuation of any other
legal proceedings or process, such as the presentation of a petition for winding up, the appointment of an administrator
or administrative receiver, the forfeiture of leases or any execution or distress levied except with the leave of the
court where specified in law and subject to such terms it may impose.
